The starting point for most people is their Trust and Estate Documents Portfolio. This package consists of your Revocable Living Trust and your Last Will and Testament. I call these the “legacy” documents which deal with post death affairs. But along with your Trust, your “living” documents may be even more important. And guess what, they, like almost every new couple, did not have their “living” documents done.

Why a Trust?
There are five critical reasons why everyone over the age of 18 needs a Trust and Last Will and Testament.
1. Preserve Family Harmony. You want to answers as many questions as possible before you die so that when you are gone there is nothing to fight about. You have spelled it all out in your Trust.
2. Control Your Stuff. If you don’t specify how you want your stuff divvied up before you die, your state has written a will for you. The laws of intestate succession are the default if you fail to make an affirmative statement.
3. Avoid Probate. Probate works but has some serious drawbacks – serious enough that it’s worth avoiding. Why needlessly pay attorneys fees and court cost to delay the distribution of you estate? Trusts keep your affairs private and because they survive your death the ownership of your assets does not need to be changed, which is what probate is all about.
4. Minimize Estate Taxes. You must have a large estate to be subject to estate taxes. However, this is the first step in minimizing them.
5. Incapacity. If, for any reason, you become incompetent or unable to manage you own financial affairs, the Successor Trustee you have selected will work with you Power of Attorney to take care of things until you recover.
